Divorce Splitting Credit [04:59:58 AM Thursday, July 03, 2008]

Divorce Splitting the Debt into Individual Names

Before the marriage and some time after it, most people strongly believe they will be always together. However, the knot once tied so tightly, can never be secured against break-up. Marital agreement is also often ignored as 'non-romantic'.

The popularity of after-divorce credit counseling testifies to the fact that the awesome majority of newlyweds and spouses do not have a clear idea of how divorce can affect their credit histories. It seems to be rather strange, since credit score damage is one of the most common financial problems initiated by divorce.

As a matter of fact, there are a limited number of cases when former husband and wife will face damaged credit as the result of their break-up. Usually, joint credit card accounts and joint loans are the obstacles on the way to flawless divorce. The bank does not care what you decided to do with your finances after divorce. The loans and credit card debt should be paid off, so the bank goes on sending statements and bills to you. No matter, if you have business credit cards or secured plastics, the two names on the account mean both the parts should pay.

Filing for divorce complicated by financial issues, you should be ready for the following state of things. Most divorces are not quite peaceful, so the spouses argue about whose responsibility is paying out the loans and credit cards. In fact, no one is really more responsible than the other, if you have joint accounts. This is why the court usually decides that the debt is divided into two parts of the divorce, according to their individual income, so that each of the former spouses could eliminate the debt on his/her own.

Where is the danger of bad credit score, you might ask. After divorce, you cannot control or just be in the know of how your former spouse manages his/her finance. This is why in a month or two you can be surprised by the negative record in your credit history, which shows that the other user of your joint account failed to make the payment. This is really the trap of joint credit cards: both sides should make regular payments; otherwise both credit scores will be damaged. What can you do to make your former better half be punctual with payments? Usually nothing. But there is a way to save your credit score.

Divorce is not as unexpected as flu. So, before you file for it and court proceedings start, you and your partner should do everything possible to eliminate all possible problems. If you feel you can't save your marriage and your life and the life of your spouse get more and more separate, think of the financial issues. Separate you cell phone and bank accounts. It is absolutely necessary to split credit card accounts, because delinquency on credit cards is much too frequent. Establish a credit history of your own and ask the bank to let you and your soon-to-be ex partner to reduce your joint debts separately.

These actions will undoubtedly take some effort, but you will feel secure from bad credit history and a lot of complications during the trial.
